When to get your marriage license and what you will need

In Massachusetts, you should apply for your marriage license (also called "filing marriage intentions") at least three days before your wedding ceremony, but not more than 60 days prior. You'll need to apply in person at the town or city clerk's office where one of the parties resides, or where the wedding will take place. The license is valid for 60 days from the date of application. 


Here's what you'll need:

  • Identification: Both applicants need to provide valid photo identification, like a driver's license or passport. 


  • Proof of age: You need to be at least 18 years old to marry in Massachusetts. 


  • Social Security numbers: You'll need to provide your Social Security numbers. 


  • Information about previous marriages: If either of you have been previously married, you'll need to provide information about the end of that marriage, such as a divorce decree or death certificate. 


  • Payment: There is a fee for the marriage license application. 


  • Information about your officiant: You'll need to provide the name and contact information for the person who will be officiating your ceremony, such as a Justice of the Peace or clergy member. 


  • Location and date of wedding: You'll need to know where and when your ceremony will take place. 


    It's recommended to check with the specific town or city clerk's office where you plan to apply for any additional requirements or specific procedures they may have.

    In Rhode Island, couples can apply for a marriage license up to three months before their wedding date, and it must be used within that three-month period. There's no mandatory waiting period after obtaining the license. Couples need to apply in person at a city or town hall, presenting photo identification, a certified birth certificate, and proof of any previous marriages. 

    To obtain a marriage license in Rhode Island, couples need:

    • Proof of Birth Facts: Preferably a long-form certified copy of their birth certificate. If born outside the US, a passport or alien card may be accepted if a birth record is unavailable. 

    • Valid Government-Issued Photo ID: Such as a driver's license. 

    • Proof of Current Address: If the address on the photo ID is different from the current address. 

    • Proof of Previous Marriages (if applicable): Certified copies of final divorce decrees or death certificates for previous spouses. 

    • Payment: A fee of $24 is required. 

    Important Considerations:

    • No Waiting Period:

      There is no waiting period between obtaining the license and getting married. 

    • Location:

      Couples can apply at the city or town hall where either one resides, or if both live out of state, at the clerk's office in the town or city where the ceremony will take place. 

    • Validity:

      The license is valid for three months from the date of issuance. 

    • Minors:

      Individuals under 18 need additional requirements and potentially court permission. 

    • Contact the Clerk's Office:

      It's recommended to contact the specific city or town clerk's office where you plan to apply for any additional requirements or specific instructions.
